COMMUNITY CYCLING PRIVACY POLICY

Community Cycling is a cycling program operated by Community Brewing Co, LLC.   Community Brewing Co., LLC operates under the name of "Community Beer Co."  Community Beer Co. organizes a cycling club and cycling team to promote healthy living, cycling culture, and community camaraderie within North Texas and the great state of Texas. Also, sponsor and/or participate in charitable rides benefiting a wide range of non-profits. Much of the charitable work is organized through the Community Cycling group.

This Privacy Policy explains how Community Cycling collects, uses, and protects information through Community-Cycling.com, its ride-registration system, and related email and text-message communications.

1. Information We Collect

We may collect the following information from riders and registrants:

• Name

• Email address

• Mobile telephone number

• Account login and profile information

• Ride selections and registration status

• Ride-group or route selection

• Cycling experience level

• Information about additional riders included in a registration

• Waiver acceptance records, including the date and method of acceptance

• Communication preferences and consent records

• Messages, requests, and other information submitted through the website

• Basic technical information needed to operate and secure the website, such as browser information, IP address, and activity logs

Please do not submit sensitive personal information that we have not requested.

2. How We Use Information

We may use collected information to:

• Create and manage rider accounts

• Register riders for Community Cycling rides

• Assign riders to ride groups or routes

• Confirm, update, or cancel registrations

• Communicate ride schedules, changes, cancellations, weather notices, safety information, and ride-day logistics

• Send requested email and SMS notifications

• Maintain waiver and consent records

• Provide customer support

• Prevent fraud, misuse, or security incidents

• Improve the registration system and Community Cycling program

• Comply with legal obligations and enforce our agreements

3. Additional Riders

A registrant may provide information about additional riders participating under the same registration. By submitting another rider’s information, the registrant represents that they are authorized to provide that information and to receive registration communications concerning those riders.

Each participant must satisfy any applicable waiver, consent, eligibility, and safety requirements. A registrant may not waive another adult participant’s legal rights unless legally authorized to do so.

4. Email Communications

We may send transactional or operational emails concerning accounts, registrations, ride confirmations, ride changes, cancellations, safety information, and ride-day logistics.

Where required, promotional or general marketing emails will include an unsubscribe mechanism. Unsubscribing from promotional emails may not stop essential account, registration, safety, or transaction-related communications.

5. SMS Communications

When a person separately opts in to Community Cycling text messages, we may send SMS messages concerning:

• Ride-registration confirmations

• Registration updates

• Ride reminders

• Schedule or location changes

• Weather notices

• Ride cancellations

• Safety information

• Ride-day logistics

• Account or support requests

Message frequency varies based on the rides for which a person registers and the operational needs of the Community Cycling program. Message and data rates may apply.

 

Consent to receive text messages is not a condition of registering for or participating in a ride. Text STOP to opt out. Text HELP for assistance.  We may send one final message confirming an opt-out request.

 

Opting out of SMS messages will not prevent us from communicating through email or other appropriate methods concerning an active registration, subject to applicable law and the registrant’s communication preferences.

6. Mobile-Information Sharing

We do not sell, rent, or share mobile telephone numbers, SMS opt-in information, or SMS consent records with third parties or affiliates for their marketing or promotional purposes. We may disclose mobile information to service providers that help us operate our messaging program, such as telecommunications carriers, messaging platforms, website providers, and technology vendors. These providers may use the information only to perform services for Community Cycling and may not use it for their own marketing. SMS opt-in consent and consent records will not be sold or shared with third parties or affiliates for marketing or promotional purposes.

7. Other Information Sharing

We may share information:

• With vendors that provide website hosting, registration, email, SMS, payment, analytics, data storage, security, or support services

• With ride organizers, employees, volunteers, or contractors who need the information to administer rides

• When required by law, court order, subpoena, or governmental request

• To investigate fraud, protect safety, enforce our agreements, or protect our legal rights

• As part of a merger, financing, sale, restructuring, or transfer of all or part of the organization or its assets

Service providers are permitted to process information only for authorized business purposes and subject to appropriate contractual or legal restrictions.

8. Data Retention

We retain information for as long as reasonably necessary to:

• Administer accounts and ride registrations

• Maintain waiver and participation records

• Document email and SMS consent

• Resolve disputes

• Meet insurance, accounting, safety, and legal requirements

• Enforce our agreements

We may retain proof of SMS consent until consent is withdrawn and for any additional period required to document legal or regulatory compliance.

9. Data Security

We use reasonable administrative, technical, and organizational safeguards intended to protect personal information. No website, database, or communication system can be guaranteed to be completely secure.

Users are responsible for protecting their account credentials and notifying us promptly of suspected unauthorized account access.

10. Your Choices

Depending on the nature of your request and applicable law, you may ask us to:

• Update or correct your account information

• Cancel a ride registration

• Close your account

• Change your communication preferences

• Stop promotional email communications

• Stop SMS communications by texting STOP

• Ask questions about the information we maintain

Certain information may be retained when required for legal, insurance, waiver, safety, fraud-prevention, or recordkeeping purposes.

11. Children

The website is not directed to children under 13, and children under 13 may not create their own accounts or independently submit personal information. A parent or legal guardian must provide information and complete any required registration or waiver process for a minor. Additional age requirements may apply to particular rides.

12. Third-Party Services and Links

The website may use or link to third-party services. Those services may have their own privacy policies and practices. Community Cycling is not responsible for the privacy practices of an independently operated third-party website or service.

13. Changes to This Policy

We may update this Privacy Policy periodically. The revised policy will be posted on the website with an updated effective date. Material changes may also be communicated through the website, email, or other appropriate means.

These Terms of Use govern access to and use of Community-Cycling.com, Community Cycling accounts, ride-registration services, email and SMS communications, and related features.

Community Cycling is a cycling program operated by Community Beer Companies. By accessing the website, creating an account, registering for a ride, or using the services, you agree to these Terms.

​

1. Eligibility and Accounts

You must provide accurate, current, and complete information when creating an account or registering for a ride.

You are responsible for:

• Maintaining the confidentiality of your account credentials

• Activities conducted through your account

• Updating inaccurate or outdated information

• Notifying Community Cycling of suspected unauthorized account use

We may suspend or terminate accounts used fraudulently, unlawfully, or in violation of these Terms.

2. Ride Registrations

Ride availability, capacity, route options, ride groups, experience classifications, schedules, starting locations, and participation requirements may change. A registration is not transferable unless Community Cycling expressly permits a transfer. Registering does not guarantee that a ride will occur as originally scheduled. Community Cycling may accept, reject, modify, reassign, or cancel a registration when reasonably necessary for safety, capacity, rider qualification, route availability, weather, operational needs, or compliance with applicable requirements.

3. Ride Groups and Experience Levels

Community Cycling may offer multiple ride groups or route options for each ride. Participants are responsible for honestly selecting an experience level and ride group appropriate for their fitness, experience, equipment, and ability. Community Cycling may reassign or remove a participant from a ride group when organizers reasonably determine that doing so is necessary for safety or ride operations. Ride descriptions, pace ranges, distance estimates, difficulty classifications, elevation information, and estimated completion times are informational estimates and are not guarantees.

4. Additional Riders

A registrant may be permitted to add other riders to a registration. The primary registrant represents that:

• The information provided about each additional rider is accurate

• The registrant has permission to provide that rider’s information

• Each rider has been informed of applicable ride requirements

• Each rider will complete any waiver, consent, or acknowledgment legally required of that rider

Parents or legal guardians may register minors only when permitted by Community Cycling and must complete all required parental or guardian documents.

5. Waiver and Assumption of Risk

Cycling involves inherent risks, including falls, collisions, traffic, road or trail conditions, weather, equipment failure, physical exertion, serious injury, permanent disability, and death.  Participation may require acceptance of a separate waiver, release of liability, assumption-of-risk agreement, media release, safety acknowledgment, or other participation document. The separate waiver presented during registration is incorporated into these Terms by reference. If these Terms conflict with a separately accepted waiver concerning participation risks or liability, the waiver will control to the extent permitted by law.

A participant who does not complete the required waiver process may not participate.

6. Participant Responsibilities

Each participant is responsible for:

• Determining whether they are physically and medically able to participate

• Using a properly maintained bicycle and appropriate safety equipment

• Wearing any helmet or equipment required by Community Cycling or applicable law

• Following traffic laws, posted rules, ride-leader instructions, and safety procedures

• Riding within their ability and maintaining control of their bicycle

• Bringing appropriate hydration, nutrition, repair supplies, and identification

• Behaving safely and respectfully toward other riders, volunteers, property owners, and the public

• Leaving a ride or route when directed by an organizer for safety reasons

Community Cycling does not provide medical advice. Participants should consult an appropriate healthcare professional regarding their ability to participate when necessary.

7. Changes and Cancellations

Community Cycling may change, postpone, relocate, shorten, reroute, combine, suspend, or cancel a ride because of:

• Weather

• Unsafe road, trail, or traffic conditions

• Emergencies

• Insufficient participation

• Permit or venue issues

• Equipment or staffing limitations

• Governmental orders

• Events beyond our reasonable control

Notices may be delivered through the website, email, SMS, or other reasonable methods. Participants are responsible for reviewing updates before traveling to a ride. Community Cycling is not responsible for travel expenses, lodging, lost income, equipment expenses, or other costs incurred because of a ride change or cancellation, except where expressly required by law.

8. Email Communications

By providing an email address, you authorize Community Cycling to send emails necessary to administer your account and ride registrations, including confirmations, reminders, schedule changes, cancellation notices, safety information, and ride-day logistics. Promotional emails, when sent, will follow applicable email-marketing requirements and include an appropriate unsubscribe method. Unsubscribing from promotional emails may not stop essential transactional, safety, account, or registration-related emails.

9. Community Cycling SMS Program

When you separately opt in to the Community Cycling SMS program, you agree to receive recurring automated or non-automated text messages from Community Cycling at the mobile number you provide.

Messages may include:

• Registration confirmations

• Ride reminders

• Registration updates

• Schedule or location changes

• Weather alerts

• Ride cancellations

• Safety notices

• Ride-day instructions

• Account or customer-support messages

Message frequency varies. Message and data rates may apply. Consent to receive SMS messages is not a condition of registering for or participating in a ride.

​

Text STOP to cancel SMS messages. Or contact us using the information below. After an opt-out request, you may receive one message confirming that the opt-out has been processed. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier availability, network conditions, device compatibility, and other factors outside Community Cycling’s control. You represent that you are the subscriber or customary user of the mobile number provided and that you are authorized to consent to messages sent to that number. You must notify us or opt out if the number is reassigned or no longer belongs to you. For information about how mobile information is handled, review the Community Cycling Privacy Policy above. 

 

10. Acceptable Use

You may not:

• Use the website for an unlawful, fraudulent, or abusive purpose

• Impersonate another person

• Submit false registration or waiver information

• Access another person’s account without authorization

• Attempt to disrupt, damage, reverse engineer, or bypass the website’s security

• Use automated systems to scrape or overload the website

• Upload malicious code

• Harass ride participants, volunteers, employees, or organizers

• Resell or commercially exploit the services without written authorization

11. Intellectual Property

The website, software, text, graphics, logos, photographs, route materials, and other content are owned by or licensed to Community Beer Companies and are protected by applicable intellectual-property laws. You may use website materials only for personal, noncommercial participation in Community Cycling activities unless we provide written permission for another use.

12. Third-Party Services

The website may depend on third-party providers for hosting, maps, route files, email, SMS, authentication, data storage, or other services. Community Cycling is not responsible for interruptions, errors, security incidents, or content controlled solely by an independent third-party provider, except to the extent responsibility cannot legally be excluded.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its services are provided “as is” and “as available.”

Community Cycling does not guarantee that:

• The website will always be available, secure, or error-free

• A ride will occur as scheduled

• Route information will be complete or free of hazards

• Email or SMS messages will always be delivered

• A particular ride group will be available

• Website information will always be current or accurate

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, Community Cycling, Community Beer Companies, and their owners, affiliates, employees, volunteers, contractors, ride leaders, and representatives will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from use of the website or registration services. Participation-related injuries, risks, and liabilities are also governed by the separately accepted waiver and release. Nothing in these Terms limits liability that cannot legally be limited under applicable law.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Community Cycling, Community Beer Companies, and their representatives from claims, losses, liabilities, and reasonable expenses arising from:

• Your violation of these Terms

• False information you submit

• Your unauthorized submission of another person’s information

• Your misuse of the website

• Your unlawful or intentionally harmful conduct

This provision does not alter rights or obligations established in an applicable participation waiver.

16. Suspension and Termination

We may suspend or terminate access to the website or a ride when reasonably necessary to protect safety, prevent misuse, comply with law, or enforce these Terms. Provisions that logically should continue after termination—including waiver, liability, intellectual-property, dispute, and recordkeeping provisions—will survive.

17. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute that is not controlled by a separately accepted waiver shall be brought in a court of competent jurisdiction located in Dallas, Texas, unless applicable law requires otherwise.

18. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted with a revised effective date. Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms, except where additional affirmative consent is required by law.
